Key Features of the Amendment
1. Composition of the Union Committee
For the forthcoming election, the Union Committee will consist of 200 members.
Thereafter, the strength will be determined on the basis of MOR/50, subject to a minimum of 160 members.
This provision will provide flexibility to adjust the committee strength in accordance with the changing manpower/organisational structure.
2. Tenure of the Union
The tenure of the Union will be governed by the provisions applicable under the Industrial Relations Code, 2020.
Under the amended Bye-Laws, the normal tenure will be three years from the date of certification.
An additional period of up to six months may be provided where necessary for concluding important discussions/negotiations with the Management.
If the Government of India subsequently notifies/amends the applicable provision under the Industrial Relations Code and the permissible tenure becomes five years, the corresponding change will automatically apply to the Union, without requiring a separate amendment for this purpose.
This amendment is particularly noteworthy because it is the fourth amendment to the Constitution and Bye-Laws of Tata Workers’ Union in its 106-year history, after having been approved first by the Executive Committee and subsequently by the Annual General Meeting (AGM) last year, and now finally approved by the Registrar, Government of Jharkhand.
